Terms of Service

1. Acceptance of Terms

Waendr ("the Platform") is operated by Yogesh Kumar, a sole proprietor based in Mexico. By accessing or using the Platform, including our website, mobile applications, and APIs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification at least 30 days before they take effect.

2. Eligibility

You must be at least 18 years old to use Waendr. By creating an account, you represent that you meet this age requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your profile information up to date.

You may authenticate via Google, Apple, or email. Each person may maintain only one account. Automated or bot accounts are not permitted.

4. User Content

You retain ownership of all content you post on Waendr, including photos, reviews, trip summaries, and comments ("User Content"). By posting User Content, you grant Waendr a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the Platform and for promotional purposes.

You agree not to post content that:

• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or threats
• Is sexually explicit or exploitative
• Promotes illegal activities or violence
• Contains spam, malware, or deceptive content
• Violates the privacy of others

5. Community Standards & Reputation

Waendr uses a reputation system to maintain community quality. Your reputation score affects your access to certain features (e.g., downvoting requires 125+ reputation). Attempting to manipulate the reputation system through fake accounts, vote rings, or other artificial means will result in account suspension.

Content may be hidden if it receives a score below -5 from community voting. Users with sufficient reputation may flag content for moderator review.

6. AI-Generated Content

You are solely responsible for verifying all travel arrangements, making reservations, and ensuring the suitability of any recommended destination or activity. AI-generated content should not be relied upon as the sole basis for travel decisions, especially regarding safety, health, or legal requirements.

7. Trip Sharing & Cloning

When you share a trip to the feed, other users may clone your itinerary. Cloning creates a copy for their personal use and awards you +25 reputation points. By sharing a trip, you consent to this cloning functionality. You may choose not to share trips if you do not wish them to be cloned.

8. Payments

If you purchase a premium subscription or paid feature, payments are processed by Stripe. We do not store your credit card numbers. All payment data is handled directly by Stripe in accordance with PCI-DSS standards. Your billing relationship for payments is with Stripe; please refer to Stripe's Privacy Policy for details on how they handle your payment data.

9. Intellectual Property

The Waendr name, logo, design, and all software, prompt engineering, knowledge graphs, design assets, and proprietary algorithms are the property of Waendr and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without prior written consent.

10. Third-Party Services

Waendr integrates with third-party services including Google Maps, Google Places, Auth0, and Anthropic Claude. Your use of these integrated services is subject to their respective terms and privacy policies. Waendr is not responsible for the availability, accuracy, or policies of third-party services.

11. Termination

You may delete your account at any time through Profile Settings. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your content may remain on the Platform to the extent it has been shared, cloned, or referenced by other users.

12. Limitation of Liability

To the maximum extent permitted by law, Waendr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages arising from travel decisions made based on AI-generated recommendations.

Our total liability for any claim shall not exceed the amount you have paid to Waendr in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We make no guarantees about the accuracy or completeness of any content, including AI-generated itineraries and user-submitted reviews.

14. Governing Law

These Terms are governed by the federal laws of the United Mexican States. Any disputes arising under these Terms shall be submitted to the competent courts of Mexico City, CDMX, Mexico, and you hereby consent to the exclusive jurisdiction of such courts.
